Terms and Conditions for Village of Schaumburg SMS Text Messaging Services

Set forth below are the terms and conditions governing the use of the Village of Schaumburg’s SMS Text Messaging Services (“SMS Service”). ANY PERSON WHO USES THE SMS SERVICE IS DEEMED TO HAVE ACCEPTED THESE TERMS AND CONDITIONS AND AGREES TO BE BOUND BY THEM.


1. Service and Service Provider

1.1 Engagement of Service

Any person may engage the SMS Service by sending a designated keyword to the provided short code or by subscribing through a designated web form or other electronic means. Individuals who engage the SMS Service are referred to herein as “End-Users.” Messages corresponding to specific keywords will be delivered to the End-User’s mobile device. Subscriptions may include informational alerts or updates from the Village.

1.2 Service Provider

The SMS Service is provided by the Village of Schaumburg, located at 101 Schaumburg Court, Schaumburg, Illinois 60193, in coordination with selected technology vendors (collectively referred to as the “SMS Contractors”). 1.3 Access

The SMS Service is available through major mobile phone service providers throughout the United States, including but not limited to AT&T, Verizon Wireless, T-Mobile, US Cellular, and others.

1.4 Charges

There are no additional fees for using the SMS Service imposed by the Village of Schaumburg or its SMS Contractors. End-Users may incur standard text messaging or data charges from their mobile service provider. Message and data rates may apply.

1.5 Messaging Frequency and Opt-Out

Single-use messages or ongoing alerts may be delivered depending on the nature of the subscription. End-Users must opt-in to receive recurring alerts. To stop receiving messages, End-Users may text the word STOP to the designated short code.

1.6 Help

To receive additional information about the SMS Service, End-Users may text the word HELP to the short code used for the service.


2. End-User Responsibilities

2.1 Wireless Service Requirement

End-Users are responsible for maintaining a mobile device capable of receiving text messages and connected to a functioning wireless network.

2.2 Agreement with Wireless Provider

The Village of Schaumburg has no authority or control over the End-User’s agreements with wireless service providers and is not responsible for any charges, issues, or breaches arising from such agreements.

2.3 Consent to Use Device

By using the SMS Service, the End-User affirms that they either own the mobile device or have the consent of the device owner.

2.4 Acceptance of Terms

Use of the SMS Service constitutes acceptance of these Terms and Conditions.


3. Termination

3.1 Termination for Cause

The Village of Schaumburg or its SMS Contractors may terminate access to the SMS Service at any time, including but not limited to the following reasons:

  • Breach of these terms by the End-User.
  • Breach of wireless provider agreements.
  • Compliance with legal or regulatory requirements.

3.2 Termination for Convenience

The Village of Schaumburg may discontinue the SMS Service at its discretion, with or without notice.


4. Service Availability

4.1 Network Limitations

The SMS Service may be affected by coverage limitations, interference, or outages related to third-party wireless networks. The Village is not responsible for service disruptions caused by such issues.

4.2 Standard of Service

While the Village of Schaumburg and its contractors will strive to provide the SMS Service with reasonable care and competence, no guarantees of service availability or reliability are made.


5. Disclaimer of Warranties

The SMS Service is provided “as is” without any warranties, express or implied. The Village of Schaumburg expressly disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement. The Village shall not be liable for any damages resulting from:

  • Data loss
  • Service interruptions
  • Equipment or software failure
  • Errors or inaccuracies in information delivered via the SMS Service
  • Third-party charges
  • Personal injury, business interruption, or consequential damages


6. Data Protection

6.1 Personal Data

The Village of Schaumburg and its contractors will only use personal data (e.g., phone numbers) provided through the SMS Service to deliver communications or updates. Personal data will not be sold or disclosed to unauthorized third parties.

6.2 Non-Personal Data

Aggregate, non-identifying data may be used for operational analysis, service improvements, or other internal purposes.


7. Data Usage Restriction

Information received through the SMS Service is for the End-User’s personal, non-commercial use only. Republishing, altering, or redistributing such data without prior written consent is strictly prohibited.


8. Limitation of Liability

The Village of Schaumburg and its SMS Contractors will not be held liable for delays or failures in message delivery due to:

  • Telecommunications disruptions
  • Natural disasters
  • Network outages
  • System failures
  • Unauthorized access or misuse
  • Governmental or regulatory action


9. Entire Agreement 

These Terms and Conditions constitute the full agreement between the End-User and the Village of Schaumburg regarding use of the SMS Service. They may be updated or modified at any time.


10. Governing Law

These Terms shall be governed by the laws of the State of Illinois. All disputes will be subject to the jurisdiction of courts located in Cook County or DuPage County, Illinois.
